These Terms of use (“Terms”) govern your access to and use of the EffortlessCoach application, websites, and related services (the “Services”), operated by Digital Blue Solutions Ltd (“we”, “us”, “our”). By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Eligibility

• The Services are available only to individuals aged 18 years or older.
• By using the Services, you confirm that you meet this requirement. We reserve the right to require age verification.
• You are responsible for ensuring that the information you provide (including health and fitness data) is accurate. Any incorrect data you submit may result in inaccurate guidance, and we will not be liable for this.

3. Description of Services

• EffortlessCoach is a digital fitness and nutrition coaching application available via web, iOS, and Android platforms.
• The Services provide AI-generated fitness and dietary guidance only. The Services do not provide medical advice.
• Always seek the advice of a physician or qualified health provider before making changes to your exercise, diet, or health routines.
• The Services are for informational purposes only and should not be relied upon as a substitute for professional medical advice, diagnosis, or treatment.

4. Accounts

• You must create an account to use certain features of the Services.
• You agree to provide accurate, current, and complete information and to keep this information updated.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You may not share your account with others or allow unauthorized use.

5. Subscriptions and Payments

• We offer a free trial period of 14 days (excluding AI tools), after which users may choose between a limited free tier or a paid subscription.
• The paid subscription is billed at £2.99 GBP per month and includes full access to the Services, including AI-generated coaching advice.
• Payments are processed exclusively through Stripe via our web application. We do not process payments through app stores.
• Subscriptions automatically renew each month until cancelled.
• You may cancel your subscription at any time via your account settings. Access will continue until the end of the paid period.
• Refunds will be handled in accordance with applicable consumer laws, including the UK Consumer Contracts Regulations, where relevant.

6. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose.
• Share, resell, or sublicense your account.
• Copy, modify, reverse engineer, decompile, or attempt to extract source code from the Services.
• Upload, transmit, or distribute harmful code, spam, or abusive content.
• Misuse the Services in a way that could damage, disable, overburden, or impair them.

7. Intellectual Property

• All intellectual property rights in the Services, including software, content, branding, logos, and design, are owned by or licensed to Digital Blue Solutions Ltd.
• You are granted a limited, non-exclusive, non-transferable licence to use the Services for personal, non-commercial purposes only.
• Nothing in these Terms transfers ownership of any intellectual property rights to you.

8. Health Disclaimer

The Services provide fitness and dietary guidance only. We are not a medical organisation and cannot give medical advice. Always consult with a qualified healthcare professional before making any changes to your health routines. If you experience faintness, dizziness, pain, or shortness of breath, stop immediately and seek medical assistance.

9. Limitation of Liability

• To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, business, goodwill, or data.
• Our total liability for any claims arising out of or relating to the Services shall not exceed the amount paid by you in subscription fees in the preceding 12 months (if any).
• Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

10. Termination and Suspension

• We may suspend or terminate your account immediately if you breach these Terms, fail to pay subscription fees, or misuse the Services.
• You may stop using the Services and close your account at any time.
• Upon termination, your right to access the Services will cease immediately. Some provisions (such as Intellectual Property, Limitation of Liability, and Governing Law) will continue to apply after termination.

11. Changes to the Services

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, including features and pricing. Where changes are material, we will provide notice via email or within the Services.

12. Governing Law and Jurisdiction

• These Terms shall be governed by and construed in accordance with the laws of England and Wales.
• You agree that the courts of England and Wales shall have exclusive jurisdiction over any disputes arising from these Terms or your use of the Services.
• If you are a consumer outside the UK, you may also have mandatory rights under your local laws, which remain unaffected.

13. Changes to these Terms

We may update these Terms from time to time. The revised Terms will be effective as of the date published. If changes are material, we will notify you in advance (for example, by email or an in-app notification).
